4. AI-Powered Services

AutoSage provides AI-powered automotive analysis services. Our platform uses artificial intelligence to analyze vehicle data, generate insights, and provide recommendations.

4.1 Limitations of AI Services

While we strive to provide accurate and reliable information, you acknowledge that:

  • Our AI-generated insights and recommendations are for informational purposes only
  • The accuracy of our Services depends on the quality and completeness of the input data
  • Our AI systems may have limitations and cannot detect all vehicle issues or accurately predict all outcomes
  • You should not rely solely on our Services for critical vehicle purchasing decisions

4.2 Professional Inspection

Our Services are not a substitute for a professional vehicle inspection. We recommend having any vehicle professionally inspected before purchase.

5. User Conduct

You agree not to:

  • Use the Services for any illegal purpose or in violation of any local, state, national, or international law
  • Violate or encourage others to violate the rights of third parties, including intellectual property rights
  • Submit false or misleading information
  • Upload or transmit viruses, malware, or other types of malicious software
  • Attempt to gain unauthorized access to our Services, systems, or networks
  • Interfere with or disrupt the integrity or performance of our Services
  • Engage in automated use of the system, such as scraping without our express written permission
  • Attempt to circumvent any technological measure implemented by us to protect the Services
  • Advocate, encourage, or assist any third party in doing any of the foregoing

6. Subscriptions and Payments

We offer various subscription plans for our Services. The features and limitations of each plan are described on our website. We reserve the right to modify, terminate, or otherwise amend our offered subscription plans.

6.2 Payment Terms

You agree to pay all fees associated with your selected subscription plan. All payments are non-refundable except as expressly set forth in these Terms or as required by applicable law.

6.3 Subscription Renewal and Cancellation

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings or by contacting us at team@autosage.com.

6.4 Price Changes

We reserve the right to adjust pricing for our Services. If the price of your subscription changes, we will notify you before the change takes effect.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Services and all materials therein, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, and music (the "AutoSage Content"), and all intellectual property rights related thereto, are the exclusive property of AutoSage and its licensors.

7.2 Limited License

Subject to your compliance with these Terms, AutoSage grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal or internal business purposes.

7.3 User Content

You retain all rights in the User Content you submit, post, or display on or through the Services. By submitting, posting, or displaying User Content, you grant AutoSage a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display the User Content in connection with the operation of the Services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

AUTOSAGE DOES NOT WARRANT THAT (I) THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS, (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.

9. Limitation of Liability

IN NO EVENT SHALL AUTOSAGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT AUTOSAGE IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnity

You agree to defend, indemnify, and hold harmless AutoSage, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

11. Termination

We may terminate or suspend your access to all or part of the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within San Francisco County, California.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
